The Land Use Committee invites all interested neighbors to attend the Hearing. Please allow a little extra time for parking and going through security at the City County Building.
Our Land Use Committee and neighbors who discussed the art theater, restaurant and small retail project in three, well attended public meetings, voted overwhelmingly to resolve to support this project, contingent on use restrictive Commitments and adjustments to the Plan of Operation and Site Plan. The neighborhood board voted unanimously to support the Land Use Committee's resolution and submitted a letter of support to DMD Staff.
The project was heard on October 12th and many neighbors attended the hearing, many in support and a few as remonstrators. After listening to the remonstrators ("old orchard club"), the Staff assigned to the project, the petitioner (Justin Kingen) and his clients (Ben and Sam Sutphin, Tom and Ed Battista), Public House Cinema (who plan to occupy), two City Councilors (including Zach Adamson), supporters from Historic Landmarks, Central Indiana Community Foundation, Riley Area Development, Windsor Park Neighborhood Assoc. Land Use Co-Chair (Micah Hill) and more...the Hearing Examiner recommended the project for approval. You can watch the video here.
Because two neighbors filed an appeal, the MDC scheduled the project to be heard on November 1st. Because the neighbors appealing requested a continuance, the hearing was rescheduled for December 6th. The project was heard again, in full, with petitioners, supporters and remonstrators presenting their plans and positions at the hearing on December 6th. The MDC was tied with one member abstaining on the rezone and variance. The alley vacation passed.
So, the rezone and variance will now be reheard on 12/20.
